These Terms of Service (“Terms”) govern your use of elkoycats (“we,” “us,” “our”) and the purchase of products from elkoycats.com (the “Site”). By accessing the Site or placing an order, you agree to these Terms.

1) Eligibility

You must be at least the age of majority in your jurisdiction to place an order. By ordering, you confirm you have the legal right to do so.

2) Products & made-to-order nature

Our products are custom-made to order based on images you upload. Because products are personalized, changes or cancellations may not be possible once production begins (see Section 8).

3) Photo uploads & customer responsibilities

When you upload images to create a custom set, you agree that:

You have the rights/permission to upload and use the images.

The images do not violate any laws or third-party rights (copyright, privacy, trademarks, etc.).
The content is not illegal, harmful, or abusive.
You are responsible for the quality of the images you upload. Very blurry, low-light, or low-resolution images may print softly.

4) Editing, cropping & output expectations

To prepare your set for printing, we may perform print optimization, including:

automatic cropping to fit the card format (edges may be trimmed)
color/lighting balancing
clarity/sharpening adjustments

Text-free / style options:
If a product is described as “text-free,” it contains no names, captions, or ratings. If a product includes a frame or themed design, that will be stated in the listing.

Because screens vary and printing is physical, colors may differ slightly from what you see on your device.

5) Orders, pricing & payment

All prices are shown in USD unless stated otherwise. Taxes and shipping charges (if applicable) are calculated at checkout.

We reserve the right to refuse or cancel orders in cases of suspected fraud, pricing errors, or violations of these Terms. If we cancel an order, we will refund the amount paid.

6) Shipping & delivery

Shipping times are estimates, not guarantees. Please review our Shipping Policy for current production schedule and delivery estimates.

We are not responsible for delays caused by carriers, customs, weather, or events outside our control.

7) Customs, duties & taxes

Customs policies vary by country. In most cases, shipments arrive without extra fees, but rarely duties, taxes, or customs checks may apply depending on your location. You are responsible for any fees charged by your local authorities unless stated otherwise.

8) Cancellations, refunds & returns (custom products)

Because our products are made from your uploaded photos, all sales are generally final once production has started.

If your order arrives with a printing defect, is damaged in transit, or we made an error, please contact us within 14 days of delivery with your order number and photos of the issue. We will work with you to provide a replacement or an appropriate resolution.

9) Reorders

You may reorder the same set in the future (subject to availability of our service). You are responsible for confirming the selected pack/style options and the photos uploaded for each order.

10) User content & license to fulfill your order

You retain ownership of your photos. By uploading images, you grant us a limited, non-exclusive license to use, edit, process, and reproduce the images only as needed to produce, fulfill, and support your order (including quality checks and customer support).

We do not sell your photos.

11) Prohibited content

We may refuse content or orders that include:

illegal content
hateful/harassing content
content that infringes intellectual property or privacy rights
anything that creates safety, legal, or operational risk

12) Themed/satirical styles disclaimer (if applicable)

Certain product styles may be presented as satire or lighthearted humor. They are not intended to offend or target any group. We reserve the right to decline orders if content or context creates a credible risk of harm or violation of these Terms.

13) Intellectual property

All Site content (branding, design, text, product concepts, graphics) is owned by elkoycats or its licensors and may not be used without permission.

14) Limitation of liability

To the maximum extent permitted by law, elkoycats is not liable for indirect, incidental, special, or consequential damages. Our total liability for any claim related to an order is limited to the amount you paid for that order.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15) Changes to the service or terms

We may update products, pricing, or these Terms from time to time. The “Last updated” date will reflect changes. Continued use of the Site after updates means you accept the revised Terms.
